Summary

RMO No. 43-2009 further amends Section VIII of RMO No. 3-2009, as amended, on taxpayers who continuously fail to comply with tax rules and regulations, by replacing item 4 on the effect of lifting a closure order.

Key points

  1. Monitoring after lifting. Once the taxpayer has met the requirements and penalties, its compliance is strictly monitored through the Taxpayer Account Management Program (TAMP).
  2. Repeat violations. If the taxpayer again commits or omits the acts it was penalized for, it is subject to the Order again. The Revenue District Officer then starts the administrative and judicial action needed to re-impose the administrative and criminal penalties.
  3. RATE program. If warranted, filing of a case under the RATE (Run After Tax Evaders) program may be recommended.

Who is affected

  • Taxpayers who continuously fail to comply with tax rules and regulations
  • Revenue District Officers
