Summary

RMO No. 03-2009 amends and consolidates the guidelines on surveillance and stock-taking activities. It also implements the administrative sanction of suspension and temporary closure of business under Section 115 of the NIRC.

Key points

  1. Grounds for suspension or closure. The only grounds are failure to issue receipts or invoices by a VAT-registered or registrable taxpayer, failure to file a VAT return, understatement of taxable sales or receipts by 30% or more, and failure to register.
  2. Mission Orders and surveillance. All surveillance and apprehension must be covered by a Mission Order signed by an authorized official, such as the Regional Director or the ACIR. Overt surveillance runs for at least ten (10) days and at most thirty (30) days unless extended in writing, with a weekly progress report and at least two implementing officers.
  3. Proof needed for a closure recommendation. The head of the investigating office must attach documentary proof of the specific violation. For failure to register for VAT, the proof includes documents showing annual gross sales or receipts from VAT-covered transactions above P 1,500,000.00.
  4. Review Board and notices. A Review Board acts on the report within five (5) days. If it approves, the taxpayer receives a Forty-Eight (48) Hour Notice to explain under oath, and a 5-Day VAT Compliance Notice follows if the Board pursues action.
  5. Closure Order. If the taxpayer does not respond, gives an insufficient response, or does not comply with the 5-Day VCN, the Review Board recommends closure for the Commissioner’s approval. The establishment is physically closed and sealed, and the closure lasts not less than five (5) days and until the violation is rectified.
  6. Lifting of the Closure Order. The order is lifted after the taxpayer registers, complies with invoicing rules, files unfiled VAT returns, or amends understated returns, with payment of taxes and penalties. Partial compliance counts if payments are not less than 10% of undeclared gross receipts (sellers of services) or 5% of undeclared gross sales (sellers of goods), or 110% of the adjusted basic tax due, whichever is higher.
