Summary

RR No. 5-2016 amends RR No. 15-2012 by adding criteria for accrediting printers of official receipts, sales invoices and other commercial receipts or invoices.

Key points

  1. Additional criteria. The printer must have no pending criminal complaint filed by the BIR for tax evasion or other Tax Code offenses, whether in court or at the DOJ, or subject of a final and executory judgment. It must not be tagged in any BIR tax system as Cannot Be Located (CBL) or as Inactive.
  2. Meaning of Inactive. Inactive covers a non-individual taxpayer that notified the BIR district office of temporary cessation of operations, and a taxpayer that stopped filing all returns for the last two (2) years, which requires a notice of investigation. It also covers a newly-registered taxpayer that fails to file the returns due for the initial quarter, and a taxpayer the Commissioner identifies in a separate issuance.
  3. Validity and renewal. Accreditation is valid for five (5) years from the date of issuance of the Certificate of Accreditation. The printer applies for renewal within thirty (30) days prior to expiration.
  4. Effect on receipts and VAT claims. Only receipts and invoices from an accredited printer on the BIR List of Accredited Printers are valid for claiming Value-Added Tax. Others are deemed spurious and give no valid claim for Input Tax by the buyer.
  5. New and existing accreditations. New applications received upon effectivity are processed by the concerned office and carry five (5) years of validity. Existing accreditations are valid for five (5) years from the issuance date of their certificates, subject to renewal.
