Summary

RR No. 5-2004 further amends RR No. 9-2001 by adding tax returns and forms to be filed through the Electronic Filing and Payment System (eFPS) and by expanding eFPS coverage and revising its enrollment requirements.

Key points

  1. Added returns and forms. The additional eFPS filings are 2551 M, 0605, 1600, 1600WP, 1601F, 1604CF, 1604E, 1701, 1701Q, 1704, 2000, 2200AN, 2200M and 2552. These cover monthly percentage tax, payment form, withholding remittance and annual information returns, individual income tax returns, improperly accumulated earnings tax, documentary stamp tax, excise tax returns and percentage tax on stock transactions.
  2. Electronic or manual filing. BIR-prescribed returns may be filed electronically or manually at the discretion of the Commissioner. Returns of large taxpayers handled by the Large Taxpayers Service must be filed electronically. The Commissioner may, through a circular, mandate electronic filing for non-large taxpayers, considering BIR computer infrastructure capability. Section 27 of Republic Act No. 8792 and other laws on electronic filing and documents must be fully complied with.
  3. Expanded coverage. eFPS coverage includes the volunteering 200 or more non-LT previously identified by the BIR and the top 10,000 private corporations identified under RR No. 17-2003. They must be notified in writing by the Commissioner. Non-LT returns include those of branches located in computerized Revenue District Offices, and the provisions apply to returns filed starting July 1, 2004. Enrollment follows RMC No. 24-2001 and its updates or amendments.
  4. Due dates. BIR Form 1600 is filed on or before the 10th day of the following month. BIR Form 1601F follows the staggered due dates in the table in RR No. 9-2001. All other added returns follow the due dates in applicable laws and regulations.
  5. Branch filing. Non-large taxpayers may file a consolidated return at the head office under RR No. 1-98 or file per branch or facility. They must first update their registration with the concerned Revenue District Offices using BIR Registration Update Form (BIR Form 1905) before changing the way they file.
