Summary
RMO No. 25-2008 prescribes the guidelines for transferring Integrated Tax System data and records of delisted and newly enlisted large taxpayers.
Key points
- Transfer of registration. LTAD I and II/LTDO handle the ITS registration transfer of delisted taxpayers, while the ISDS handles enlisted taxpayers once the approved list is received. BIR Form No. 1905 is no longer required to effect the transfer, and new Certificates of Registration are generated once the transfer is done.
- Books, records and returns. After the transfer, required books and records are registered or submitted to the new office. Items already submitted to the old office count as sufficient compliance. Newly enlisted large taxpayers enroll in EFPS under RR No. 9-2001, and delisted ones keep using EFPS. During the transition, manual filing at Authorized Agent Banks needs approval of the Chief of the LTDPQAD.
- Audits and assessments. Audits under LAs/TVNs/LNs started before the transfer, including refund cases, continue with the issuing office, which gets the collection credit. Unserved 2006 LAs/TVNs/LNs of delisted taxpayers are cancelled and indorsed to the NID/Policy Cases Division, and 2007 ones are handled by the new office. Assessments (infocon, PAN, FAN, FDDA) stay with the old office until the case ends.
- Cases, TCCs and applications. Unevaluated compromise and abatement applications go to the new office, but those already routed to the TWG or REB stay with the old office. TCC applications go to the new office. Pending ATP, computerized accounting permits and other secondary registrations are processed by the new office, except permits where a complete systems walkthrough was already done by the old office.
- Collections and system access. Collections from newly-enlisted large taxpayers are credited to the LTS and from delisted taxpayers to the new RDOs starting January 1, 2008. Taxes paid under RDO Nos. 116, 121, 122 and 123 from January 2008 are taken out of the old RDO’s collections and adjusted to the LTS office. The new office gets special access to ITS and EFPS data for 3 months after the transfer.
- EFPS enrollment. Newly-enlisted large taxpayers not yet in EFPS must enroll on or before June 30, 2008. Tax returns and attachments for 2006, 2007 and 2008 manually filed with the old office are forwarded to the new office.
