Summary

RMO No. 05-2002, issued April 15, 2002, prescribes the guidelines and procedures for adopting the Electronic Filing and Payment System (EFPS).

Key points

  1. Availability and enrollment. EFPS is available to all taxpayers with an e-mail account and internet access who are registered in the BIR Integrated Tax System (ITS). They enroll online through the system linked to the BIR website. Taxpayers safeguard their user names, passwords and challenge question answers, and must re-enroll if they forget them or the corporate authorized signatory changes.
  2. What may be e-filed and when. Only returns for tax types registered in the ITS and form types available in EFPS may be filed. Initially thirteen (13) tax forms are available. E-filing is open 24 hours a day, 7 days a week, but returns must be filed on or before 10 p.m. of the due date.
  3. When EFPS is unavailable. If the BIR declares EFPS unavailable on due dates, taxpayers file manually. Returns with payment go to the collecting agent (Authorized Agent Bank or Revenue Collection Officer/Deputized Municipal Treasurer). No payment returns go to the RDO, LTS or LTDO where the taxpayer is registered.
  4. Documents to submit. EFPS filers submit audited financial statements, certificates of withholding tax, and any Tax Debit Memo (TDM) used in payment to their RDO, LTS (LTAD) or LTDO within fifteen (15) days from the date of filing.
  5. Payment. Payment may be manual or electronic, following the pay as you file principle, on the day of e-filing. No penalty applies to those who e-file earlier and pay later on or before the due date. A return paid partly in cash and partly by TDM is e-filed first, and the portions may be paid in either order on or before the due date.
  6. E-payment rules. From July 1, 2002, e-payment is mandatory for large taxpayers and other non-large taxpayers to be announced later. E-payment is through the bank debit system using internet banking of a capable Authorized Agent Bank (AAB). Tax is deemed paid once the AAB issues a Confirmation Number, and the BIR issues an Acknowledgement Number confirming credit to the government.
