Summary

RMC No. 93-2019 amends the answer to Question No. 2 of RMC No. 85-2018 on how many eCARs are issued when the taxpayer submits two separate documents, such as an Extra-Judicial Settlement and a Deed of Absolute Sale or Donation.

Key points

  1. Number of eCARs. Two (2) eCARs must be issued, though the manner of issuance depends on the transaction.
  2. Total area sold or donated. If the property sold or donated is the total area in the Original, Transfer or Condominium Certificate of Title, two (2) eCARs are issued simultaneously with the same Title number. One is for settlement of the estate and one for the sale or donation, and both must be presented to the Registry of Deeds (RD) at the same time, since presenting only one invalidates the second and leads to a Notice of Invalid eCAR.
  3. Portion of the area sold or donated. Two (2) eCARs are still issued, but the second is issued only after the estate settlement eCAR is presented to the RD for a New Title. The new Title number is the basis for the eCAR of the second transaction, and the taxpayer may pay the taxes for both transactions at the same time to avoid penalties and interest.

Who is affected

  • Taxpayers transferring real property through an estate settlement and a sale or donation
