Summary

RMC No. 79-2018 publishes the full text of Republic Act No. 11055, An Act Establishing the Philippine Identification System (PhilSys).

Key points

  1. Purpose. PhilSys is the central identification platform for all citizens and resident aliens, and a person’s record in it is official and sufficient proof of identity. It aims to simplify public and private transactions without presenting other IDs, subject to biometric authentication.
  2. PhilID card. The PhilID shows the PhilSys Number (PSN), full name, sex, blood type, optional marital status, place of birth, photograph, date of birth and address. It has a QR Code with some fingerprint information, and the PSA may provide a mobile PhilID.
  3. Acceptance. The PhilID is honored, subject to authentication, by all national government agencies, LGUs, GFIs and private entities. Examples are tax-related transactions, bank accounts, employment and school admission, and the PSN and biometrics are accepted even without presenting the PhilID.
  4. Registration and fees. Citizens must present a birth certificate, and resident aliens must show proof of residence in the Philippines. Initial issuance and renewal are free for citizens, while resident aliens and replacement cards pay a standard fee, which the PSA may waive for replacements.
  5. Data protection. PhilSys information may not be disclosed or used without the person’s specific consent, or a court order in the compelling interest of public health or safety, with notice to the owner within seventy-two (72) hours.
  6. Penalties. Refusing to accept the PhilID or PSN without just cause is fined P500,000.00. Unlawful use, falsification and data violations carry imprisonment of up to fifteen years and fines of up to P10,000,000.00, depending on the offense.
