Key points

  1. Transmission of BIR Form No. 2307. The form may be transmitted by digital means such as email, facsimile or cellphone, not only by physical delivery. Copies produced and submitted by the recipient may therefore be the original copy.
  2. Verification of authenticity. The processing office compares the CWT claimed in the taxpayer’s SAWT with the alphalist of payees attached to the withholding agents’ BIR Form No. 1604E or 1601E. If the data matches, the form is valid and authentic, and the question of an original copy becomes moot.
  3. Revised requirement in RMC No. 75-2024. The third item of Annex A.1 now calls for copies of BIR Form No. 2307 or BIR Form No. 1606, whichever applies, issued by the payor to the payee. For a claimant in real estate business, a reproduction of the original BIR Form No. 1606 suffices.
  4. Individual taxpayers. Section 76 covers corporations as defined in Section 22(B). Individuals may claim under Section 58(E), in relation to Section 204, and a new set of mandatory requirements will be prescribed for them. The policies in RMC No. 75-2024 and the procedures under RMO No. 25-2024 remain the same for corporate and individual claimants.
  5. Returns considered. Once an Electronic Letter of Authority covering the same period has been issued, the claimant cannot amend the returns. After the application is officially received, only returns filed on or before receipt are considered, and discrepancies may lead to partial or full denial.
  6. Annex changes. Annex A.1 is renumbered A.1.1, and Annex A.1.2 is added as the mandatory requirements for individual claimants. This also amends Annexes A.1, A.2 and A.4 of RMC No. 75-2024.
