Summary

RMO No. 34-2022 prescribes the revised guidelines and procedures for processing Authorized Agent Banks’ (AABs) requests for refund of over-remittance of tax collections.

Key points

  1. Basis and nature of the refund. Refunds are processed under RR No. 5-1984 (Sec. 5, A 4 and Sec. 5, B 8), Treasury Circular No. 3-2013 and the MOA among the BIR, the BTr and the AABs. A refund of over-remittance by AABs as collecting agents is not a refund of a taxpayer’s tax payment.
  2. Adjustment period. AABs may adjust erroneous remittances within five (5) days from the collection date. Adjustments beyond five (5) banking days need prior clearance from the BTr, under Part D No. 4 (d) of Treasury Circular No. 3-2013.
  3. Letter-request. The request is in writing to the Assistant Commissioner-Collection Service, attention to the Chief, Revenue Accounting Division. It states the AAB branch, collection date, over-remittance amount, remittance dates, amount of collection per BCS-A and the reasons.
  4. Attachments. The request includes an affidavit by the AAB Branch Officer and other proof, such as official receipts of other payments (SSS, credit card company, etc.) wrongly reported as BIR payments.
  5. Conditions and coverage. The procedures cover all payment channels through the banking system, manual or electronic. No refund is granted unless the collection data in CBRS-ITS or CRR-IRIS has just been adjusted, and the RDO corrects the affected BCS-A report. For large taxpayer collections, the LTDPQAD and LTDO have the RDO’s functions.
