Key points
- Committee and testing. A Drug-Free Workplace Committee is created to set up the BIR’s Drug Testing Program, which must conform with RA No. 9165. Tests are done by government forensic laboratories or DOH-accredited drug testing laboratories under Section 36 of RA No. 9165.
- When tests are done. Newly hired employees take a mandatory drug test before beginning employment. Random testing is also conducted at random intervals, giving each employee equal likelihood of being tested.
- Advocacy and education. BIR offices, through the Training Management Division, Training Delivery Division and Human Resource Management Unit, conduct advocacy, education and training programs on the dangers of drug use.
- Treatment for positive results. Employees who test positive undergo treatment based on their category. Experimenters get outpatient guidance counselling, occasional users get outpatient guidance counselling and urine surveillance, and chronic users or drug dependents get mandatory 6-month treatment in a government rehabilitation center.
- Sanctions. Refusing without valid reason to undergo rehabilitation after a positive test, or to take a random or mandatory test, may be sanctioned. Continued drug use after or during treatment may lead to suspension or dismissal. Employees caught or charged under Article II of RA 9165 may be suspended or dismissed depending on the gravity of the offense, without prejudice to criminal prosecution.
- Dismissal at first offense. An official or employee found positive for dangerous drugs faces disciplinary proceedings with a penalty of dismissal from the service at first offense, under Section 46 (19) of Book V of Executive Order 292 and Section 22 (c) of its Omnibus Rules.
