Key points

  1. Immediate implementation. Under Section 7 Rule III of Administrative Order No. 07 (Ombudsman Rules of Procedure), an Ombudsman decision in administrative cases is executed as a matter of course. All concerned implement such decisions, orders or resolutions right after their office receives them.
  2. No stay by motion or petition. Filing a motion for reconsideration or a petition for review before the Office of the Ombudsman does not stay implementation. Only a Temporary Restraining Order or Writ of Preliminary Injunction issued by a court of competent jurisdiction does.
