Key points
- Contracts of at least P500,000,000.00. When the Head of the Procuring Entity decides that a contract of at least Five Hundred Million Pesos (P500,000,000.00) falls under an exception to public bidding, the Head first obtains Government Procurement Policy Board (GPPB) approval. The GPPB must approve that the contract falls within the exceptions and that the specific alternative mode is appropriate.
- Final approval. After this, the Head of the Procuring Entity has full authority to give final approval and enter into the contract. The exception is a contract required by law to be acted upon or approved by the President.
- Certification. The Head must certify under oath that the contract was entered into in faithful compliance with all applicable laws and regulations.
