Summary

RMO No. 68-2010 sets the guidelines for verifying and surrendering Documentary Stamp Tax Electronic Imprinting Machines (DSEIMs) and for moving unused or unloaded DST balances to the Electronic Documentary Stamp Tax (eDST) System.

Key points

  1. Written request deadline. Taxpayers and users of DSEIMs with unused or unloaded DST balances file a written request for verification and transfer to the eDST System with the Assistant Commissioner, Collection Service, Attention: Chief, Collection Programs Division, on or before August 31, 2010. Unused balances still loaded after that date are deemed forfeited in favor of the BIR.
  2. Verifying offices. Large Taxpayers use the Large Taxpayers Regular Audit Divisions I to IV and Excise Audit Divisions I to II for related documents, and the Large Taxpayers Collection and Enforcement Division for verification of the machines. LTDO-Makati and LTDO-Cebu handle their own taxpayers, and all others go to the RDO with jurisdiction.
  3. Skipping verification. Users of company-owned DSEIMs who forgo verification cannot transfer any unused DST balance to the eDST System.
  4. Surrender of BIR-owned machines. BIR-owned DSEIMs with zero balances in Metro Manila go to the General Services Division at the BIR National Office Bldg., Diliman, Quezon City. Those outside Metro Manila go to the Administrative Division of the Revenue Regional Office. Company-owned machines are returned to the users.
  5. Liability for non-compliance. Users who neither surrendered BIR-owned machines nor requested verification as of August 31, 2010 are notified in writing that they are liable for U.S. $ 898.00 per unit, converted at the prevailing peso-dollar rate when paid, and that unused load balances are forfeited. Payment is made through an Order of Payment and a Government Official Receipt (Form 51).
