Summary

RMO No. 66-99, issued August 23, 1999, revises the guidelines and procedures for issuing Certificates Authorizing Registration (CARs) and reporting real and personal property transactions.

Key points

  1. Uniform CAR. Both computerized and non-computerized Revenue District Offices (RDOs) issue the revised CAR for transfers of real and personal properties. For computerized RDOs, the system-generated Tax Clearance Certificate stays on file with the docket, and its information is typewritten manually on the CAR.
  2. Requisition of forms. Only the Revenue Regional Directors may requisition CARs from the Accountable Forms Division. The Revenue District Officers then requisition forms from the Regional Directors.
  3. Capital Gains and Creditable Withholding Tax transfers. The RDO issues the CAR immediately after approving the verification report. The Assessment Division later reviews the Capital Gains Tax verification report for the Regional Director’s approval.
  4. Estate, Donor’s Tax and exempt transfers. For Estate or Donor’s Tax, the CAR goes to the executor, administrator or heir/donor after the audit/verification report is approved and the Regional Director issues a Confirmation Letter (CL). For transfers exempt from Capital Gains, Estate or Donor’s Tax, the CAR is issued only after the Regional Director approves the audit/verification and issues CLs to the RDO(s) concerned.
  5. Dry seal and release periods. All signed copies of CARs must bear the official dry seal of the Bureau before release, to avoid invalidation at the Register of Deeds and other offices. CARs are issued within five (5) days from the Tax Verification Notice, or within two (2) days from receipt of the original CLs for cases under Letters of Authority.
  6. Change of forms. The revised CAR is used starting September 1, 1999. The old CARs (BIR Form Nos. 1954, 1954 A and 1954 B) may be used until the end of working hours of August 31, 1999.
