Summary
RMO No. 38-2010 sets the policies and guidelines for posting and publishing the list of top taxpayers for taxable year 2009.
Key points
- Lists to be published. The top 300 individual taxpayers and top 150 corporate taxpayers of Income Tax are published for each Revenue District Office (RDO). The top 2,000 individual and top 1,000 corporate taxpayers of Income Tax nationwide are also published.
- Basis for ranking. For individuals, it is the Income Tax due in BIR Forms 1700, 1701 and 2316 for calendar year 2009 filed as of April 15, 2010. For corporations, it is the Income Tax due in BIR Form 1702 filed as of October 15, 2010. Taxable year 2009 means a fiscal or calendar year period ending from June 30, 2009 to June 30, 2010.
- Role of the RDO. The Revenue District Officer prepares the list of the top 300 individual taxpayers, which includes individuals in the alphalist of employees subject to withholding tax on wages, and the top 150 corporate taxpayers in the district. The lists go in electronic format to the Information System Operations Service (ISOS).
- Role of ISOS and content. The ISOS validates the RDO lists and prepares the nationwide lists for the Commissioner. Each published list shows names from highest to lowest, the Income Tax due for taxable year 2009 and the average tax due of all listed taxpayers.
- Posting and publication. The Commissioner authorizes posting and publication of the RDO and nationwide lists. This can be on the BIR website, newspaper, BIR offices and other locations the Commissioner prescribes.
