Summary
RMO No. 16-2016 sets the guidelines for media outfits to report paid commercials and advertisements of candidates in the May 9, 2016 National and Local Elections.
Key points
- Who reports. All media outfits paid to promote candidates and party-list groups in the May 9, 2016 elections must report the promotions to the BIR. This covers television, radio, print and online advertisements.
- Period covered. For President, Vice-President, Senator and party-list groups, the report covers November 9, 2015 to May 7, 2016, with a campaign period of February 9, 2016 to May 7, 2016. For House Members and elective regional, provincial, city and municipal officials, it covers December 25, 2015 to May 7, 2016, with a campaign period of March 25, 2016 to May 7, 2016.
- Where and when to file. The report and its soft copy in DVD-R go together to the RDO where the media outfit is registered, or to the Large Taxpayers Division for those registered with the Large Taxpayers Service. The deadline is not later than fifteen (15) days from the end of the campaign period, or until May 22, 2016.
- Penalties. Non-compliance carries a P1,000.00 penalty for each failure to submit on time under Section 250 of the NIRC and RMO No. 7-2015, plus inclusion in the priority audit program. Willful failure implies fraud and cannot be compromised, and paying the penalty does not relieve the outfit of submitting the report.
