Summary

RMO No. 16-2015 amends RMO No. 19-2012 on the Value-Added Tax Audit Program of the Large Taxpayers Service, widening its coverage and setting audit rules for Revenue Officers.

Key points

  1. Expanded coverage. The program now includes taxpayers whose VAT compliance is below the available established industry benchmarks, taxpayers with a discrepancy between sales per e-Sales Report or Summary List of Sales and VAT returns, and taxpayers whose excess input tax carried forward in the next quarter’s VAT return differs from the input tax in the previous quarter’s return.
  2. Audit procedures. Revenue Officers perform only the audit procedures under RAMO No. 1-99 that apply to the risks identified for case selection and pre-audit analysis.
  3. Audit plan. For each allocated case, the Revenue Officer completes an audit plan after pre-audit analysis and agrees it with the supervisor. The plan is adjusted if further risk areas are found.
  4. Docket documents. Only the documentary requirements under RMO No. 53-98 that are applicable and relevant to the case are attached to the docket. The Revenue Officer may still apply the full provisions depending on the risks found.
  5. Caseload. The initial workload is thirty (30) cases per Revenue Officer, which cannot be exceeded, subject to replenishment after each report of investigation or closure. Exceeding thirty (30) cases because of returned cases is not a violation.
