Summary
RMC No. 95-2024 clarifies issues on the monthly Documentary Stamp Tax declaration of Electronic Documentary Stamp Tax (eDST) taxpayers using BIR Form No. 2000 v 2018, following RMC No. 48-2024.
Key points
- BIR Form No. 2000 still filed separately. The form, when used for advance deposits, is a payment form and not yet a return. Because of limits in its current format, it is still used separately to declare the taxable transactions that make up the total DST due, pending revision of the form.
- Simplified Schedule 1. For taxpayers with voluminous transactions, entering ATC No. 010 and a Tax Due amount equal to the month’s total tax due in the eDST ledger is enough to complete Schedule 1.
- Penalties from eFPS. Filing the form as a declaration is a compliance requirement and is not used to pay DST, since the DST was paid in advance through deposits. Since eFPS cannot tell a return from a declaration, the compromise penalty for late filing of the declaration is the proper penalty.
- Penalty relief. Compromise penalties for non-filing or late filing of the declaration for taxable months before the date of issuance of RMC No. 48-2024 shall no longer be assessed and collected.
Who is affected
- eDST taxpayers-users filing BIR Form No. 2000 v 2018
Deadlines and effectivity
- Declaration due within five (5) days after the close of the month
