Summary
RMC No. 71-2007 circularizes the full text of Executive Order No. 646 dated August 3, 2007, on access to taxpayer information between the BIR and Local Government Units (LGUs) for tax collection.
Key points
- BIR records for LGUs. BIR records on any person, partnership, corporation or association subject to local taxes, fees and charges are made available to the local treasurer, his deputy or authorized representative, to ascertain, assess and collect the correct local taxes, fees or charges.
- LGU information for the BIR. Upon proper request of the CIR or his authorized representative, LGUs provide information such as costs and volume of production, receipts or sales and gross income of taxpayers. The BIR uses it to check returns, make a return when none was filed, determine liability, collect, or evaluate tax compliance.
- Limits on use. Access by either side is used only for these purposes and is not used for any other purpose or disclosed to unauthorized persons.
- Guidelines and sanctions. The Department of Finance issues guidelines, with due regard to the security of taxpayers’ information. BIR and LGUs that fail to comply are liable for administrative sanction under existing laws, rules and regulations.
