Summary
RMC No. 69-2018 publishes the full text of IATF Circular Letter No. 2018-8, the guidelines on Early Procurement for the Fiscal Year 2019 National Expenditure Program (NEP).
Key points
- Coverage and timing. The Circular covers all heads of National Government departments, bureaus, offices and agencies, including Constitutional Commissions, Congress, the Judiciary, the Ombudsman, State Universities and Colleges, GOCCs, Local Water Districts and LGUs. Early Procurement runs from October to December 2018, upon submission of the FY 2019 NEP to Congress, from pre-procurement conference to post-qualification and BAC recommendation of award.
- Conditions before starting. Early Procurement starts only after completing items including harmonizing the Indicative APPs for non-CSE with the FY 2019 NEP, HOPE approval of the Indicative APP, and its posting on the Transparency Seal page not later than August 31, 2018. A Multi-Year Obligation Authority from the DBM for multi-year projects and preparatory activities for civil works are also needed.
- 50% requirement. At least 50% of the volume or number of planned FY 2019 procurement must undergo Early Procurement. This clarifies or amends the 50% value requirement under AO 25 IATF MC 2018-1, and each agency submits a Certification of Compliance to the GPPB.
- Postings. Procurement advertisements follow RA No. 9184 and its IRR. The Approved Contract and Notice to Proceed are posted in PhilGEPS on or before January 31, 2019.
- After the budget is final. End-users revise the PPMP to match the final budget and the APP is revised and approved. The APP goes to the GPPB on or before the end of January of the budget year, and a Notice of Award issues only upon approval or enactment of the budget document and within the amount authorized.
