Summary
RMC No. 63-2019 circularizes RA No. 11262, which amends Sections 85 and 103 of RA No. 9593 (Tourism Act of 2009).
Key points
- TIEZA jurisdiction. The Tourism Infrastructure and Enterprise Zone Authority (TIEZA) has sole and exclusive jurisdiction to grant the incentives under RA No. 11262. It may coordinate with the Board of Investments and other agencies, and its jurisdiction cannot be impliedly repealed or modified.
- Grant of incentives. TIEZA gives equal preference to large investments, those with great potential for employment generation, and those of local small and medium enterprises. Registered tourism enterprises owned and operated by overseas Filipino investors enjoy the same incentives as TEZ operators and registered enterprises in general.
- Incentive period. The incentive schemes in Sections 86, 87 and 88 of RA No. 9593 remain in effect until December 31, 2029, subject to review by the Joint Congressional Oversight Committee. The required amount of investments is defined in the implementing rules of RA No. 9593.
- Anti-abuse rules and LGUs. TIEZA coordinates with the Bureau of Customs and the BIR on rules to prevent abuse of the incentives. Local Government Units are encouraged to give incentives, such as reductions in real estate taxes and waivers of fees, and must report any such incentives to the Department of Tourism and the Tourism Promotions Board.
