Summary
RMC No. 59-2024 sets supplemental guidelines on affixing Internal Revenue Stamps on Vapor Products, pursuant to RMC No. 105-2023.
Key points
- Enrollment in IRSIS. Stamp Order Consolidators, Importers and Local Manufacturers of Vapor Products enroll and register with the Enhanced Internal Revenue Stamps Integrated System (IRSIS) under Section 3 of RR No. 18-2021.
- Filing and payment. eFPS-enrolled Importers and Local Manufacturers pay the excise tax on stamps and inspection fees through eFPS using BIR Form No. 2200-T. During eFPS downtime, the form is filed manually with payment through AABs, then filed in eFPS by the RMO No. 65-2016 deadline. Copies and proof of payment go to the Chief, Excise LT Field Operations Division for encoding in IRSIS.
- Seven container types and 2024 rates. Nicotine Salt comes in 1 ml, 2 ml, 5 ml and 10 ml at ₱54.60 per ml, so ₱54.60, ₱109.20, ₱273.00 and ₱546.00. Conventional Freebase comes in 10 ml, 30 ml and 60 ml at ₱63.00 per 10 ml, so ₱63.00, ₱189.00 and ₱378.00. Rates rise 5% every year effective January 1, 2024.
- Transitory provisions. On May 8, 2024, 4th Generation Internal Revenue Stamps become available for ordering in the Enhanced IRSIS. From June 1, 2024, all vapor products in the market must carry the stamps. No removal from the place of production and no release from customs custody is allowed without them.
- Solidary liability. The Stamp Order Consolidator is solidarily liable with the Importer/Local Manufacturer for violations of Sections 254 and 265 of the Tax Code. Penalties under RR No. 18-2021, RR No. 14-2022 and other tax laws also apply.
