Summary
RMC No. 58-2026 prescribes the procedures for filing and paying the quarterly royalty under Republic Act No. 12253, the Enhanced Fiscal Regime for Large-Scale Metallic Mining Act.
Key points
- Coverage. It applies to large-scale metallic mining contractors and operators who must file quarterly royalty returns and pay the royalty under Section 151-A of the Tax Code. They become subject to the fiscal regime after one hundred and fifty (150) days from the Act’s effectivity, or on February 17, 2026.
- Deadline. The return is filed and the royalty paid within sixty (60) days after the close of each calendar or fiscal quarter.
- Interim filing form. Until a dedicated return and electronic facilities are available, BIR Form No. 0605 is used, electronically through eFPS for eFPS filers or manually for others. Tax type is “MC”, ATC is MC 344 for operations within mineral reservations or MC 345 for operations outside, manner of payment is “Voluntary Payment”, and the description field states “Others (Specify)” with the type and number of agreement, for example “MPSA No. 123-2026-XIII”.
- Effect of interim payment. Filing and payment through BIR Form No. 0605 counts as advance or initial compliance, subject to validation, reconciliation, and adjustment once the prescribed return is issued.
- Ring-fenced agreements. A contractor holding two (2) or more mineral agreements, FTAAs, or operating agreements files and pays separately for each. Each is a distinct ring-fenced project under Section 151-C of the Tax Code.
- Computation and records. The royalty follows Section 151-A and the DOF’s Implementing Rules and Regulations dated December 18, 2025, pending the BIR’s implementing Revenue Regulations. Rates and deductions differ for operations within or outside mineral reservations. Contractors keep and submit on request the schedules, computations, and supporting documents.
