Summary

RMC No. 58-2003 prescribes uniform formats for the sworn statement and Official Register Books used by manufacturers/assemblers, importers and dealers of automobiles, pursuant to Revenue Regulations No. 25-2003.

Key points

  1. Sworn statement. A sworn declaration is filed for each brand or model of automobile, and each variant of each brand. For imported Completely Built-Up (CBU) automobiles for sale, a copy forms part of the documents submitted to the BIR office processing the Authority to Release Imported Goods (ATRIG) application.
  2. When to file. For existing brands, the sworn statement is filed on or before the end of June and December of every calendar year. For a new brand, it accompanies the registration application before the initial manufacture, assembly or importation. If a selling price changes, an amended statement is filed before any affected removal or release from customs custody.
  3. Official Register Books. Manufacturers/assemblers, importers and dealers install and maintain Official Register Books (ORBs). A manufacturer/assembler who also imports CBU automobiles for sale keeps separate ORBs for imports. A monthly transcript is submitted in triplicate not later than every 8th day of the month. Until BIR-printed forms are available, a computer spreadsheet copy following Annexes “B-1”, “B-2” and “B-3” is used.
  4. Returned automobiles. Tax-paid automobiles returned to the place of manufacture or assembly for re-assembly or repair under a permit are entered in the ORBs under the “In-Process” and “Finished Goods” Accounts with the words “Returned for Re-assembly/Repair”.
  5. Withdrawal Certificate. A Withdrawal Certificate (WC) accompanies every removal of automobiles from the plant. It is issued by the Revenue Officers On-Premise (ROOPs). Until the form is available, delivery receipts or sales invoices are used instead, and they are presented to the ROOPs for attestation and signature on all copies before removal.
