Summary

RMC No. 42-2022 clarifies the deadline for filing the Annual Income Tax Return (AITR) for the taxable year ending December 31, 2021, with guidelines on filing, payment and non-imposition of surcharge on amended returns.

Key points

  1. Deadline and amendment. Filing and payment for CY 2021 are due April 18, 2022 (Monday), since April 15, 2022 is a non-working holiday. A tentative AITR may be filed by April 18, 2022 and amended by May 16, 2022 without interest, surcharge and penalties, and any overpayment from the amendment may be carried over as credit for the same tax type in the succeeding period or refunded.
  2. Filing system. Taxpayers required or opting to use eBIRForms file through eBIRForms, and eFPS users file electronically, except that newly created returns not yet in eFPS but available in eBIRForms are filed through eBIRForms. eFPS-mandated taxpayers file BIR Form No. 1702RT through eFPS, while Forms 1702EX and 1702MX are filed through eBIRForms with payment through eFPS using BIR Form No. 0605 (Income Tax, ATC MC 200).
  3. Payment facilities. Taxes may be paid manually through Authorized Agent Banks and Revenue Collection Officers regardless of RDO jurisdiction. They may also be paid through ePAY facilities such as the Land Bank of the Philippines Link.Biz Portal, DBP Pay Tax Online, Union Bank Online/The Portal, and providers such as GCash, PayMaya and MyEG.
  4. Manual filing of no-payment returns. Non-eFPS taxpayers file no-payment returns electronically through eBIRForms. Senior Citizens or PWDs filing their own returns, employees with purely compensation income from two or more employers (or one employer whose spouse is not entitled to substituted filing), and employees qualified for substituted filing who opt to file an ITR for purposes such as promotion, loans, scholarships or foreign travel may file manually.
  5. Electronic signature and attachments. Under RA No. 8792, an electronic signature on tax returns, attachments and documents is equivalent to a wet signature. Attachments such as BIR Form No. 1709 and Audited Financial Statements are submitted on or before May 31, 2022 to the RDO, Large Taxpayers Service or Large Taxpayers District Office where registered, or through the eAFS System.
