Key points
- Deferment. The TRO was promulgated July 1, 2005 in G.R. No. 168461 and G.R. No. 168463. RR No. 14-2005 is deferred until the TRO is lifted.
- VAT already collected. VAT collected with a VAT invoice or receipt issued must be declared in the monthly VAT declaration for the month concerned. It must be remitted to the BIR on or before the filing deadline.
- Invoices stamped under RR No. 14-2005. Non-VAT invoices or receipts stamped as VAT invoices must be re-stamped in red ink with “Non-VAT no input allowed.” A line is drawn across the earlier stamped words “VAT-registered”.
- Taxpayers who became VAT-exempt under RA No. 9337. Those who stamped “Non-VAT registered as of ____” on their VAT invoices must draw a red line across the word “Non”.
- Status and tax rates. The BIR reverts concerned taxpayers to their registration status before July 1, 2005 and notifies them. All taxpayers are liable for the taxes and rates that applied before RA No. 9337 took effect on July 1, 2005.
