Summary
RMC No. 142-2019, issued December 27, 2019, circularizes balance adjustment in the Electronic Documentary Stamp Tax (eDST) System as an option for recovering erroneously deducted DST, in addition to filing a refund claim.
Key points
- Conditions. The revised BIR Form No. 2000 must be properly accomplished, especially Part II. A. and Schedule I. The erroneously deducted amount must not have been declared in Schedule I of the return.
- Filing the request. The taxpayer-user files a written request with the Chief, Miscellaneous Operations Monitoring Division (MOMD), Collection Service, National Office. It includes documents on the incidents behind the erroneous deductions, the taxable document, and a sworn declaration that the DST was not applied to other documents or claimed as a deductible expense in the Income Tax Return.
- Evaluation and approval. MOMD evaluates the request and endorses it to the Assistant Commissioner, Collection Service for final approval. If approved, the Chief, MOMD approves it and states the reasons in the Balance Adjustment Details functionality of the eDST System.
- Notice to the taxpayer. The taxpayer-user is notified in writing or by email within five (5) working days from receipt of the RDO or Large Taxpayer Service Division’s written recommendation and supporting documents. A denial states its reasons, and says so if a refund request should have been filed instead.
