Summary

RMC No. 14-2026 clarifies RMC No. 8-2026 on lifting the audit suspension, RMO No. 1-2026, and RMO No. 6-2026 on the implementation of revised audit policies, procedures, and safeguards.

Key points

  1. Replacement eLA. A Replacement eLA issued only to keep audit authority continuous, such as after reassignment of Revenue Officers or restructuring, is an administrative adjustment and not a new audit authority. It stays limited to the same taxpayer and taxable periods, and adding periods requires the system-assisted selection and centralized approval under Section VI of RMO No. 1-2026.
  2. Earlier instruments. LOAs, eLAs, MOs, and TVNs issued before RMO No. 1-2026 remain valid and need not bear the mandatory labels unless replaced. The Single-Instance Audit Framework is prospective, and later audit actions must follow the revised framework and due process.
  3. TVN scope. A TVN is limited to the transaction or claim stated in it. Broader issues require a separate eLA before further audit activity.
  4. Challenges and waivers. Communications assailing a valid Replacement eLA do not suspend or delay the audit, and national and regional offices do not entertain them while the original authority is valid and the taxpayer, periods, and scope are unchanged. An existing Waiver of the Defense of Prescription stays valid, and earlier subpoenas and document requests continue.
  5. Consolidation dates. Two eLAs from different offices for the same taxpayer and taxable period are automatically consolidated. A timely Request for Non-Consolidation of VAT cases filed on or before March 13, 2026 lets them proceed separately only until May 15, 2026. Automatic consolidation happens on March 20, 2026, and again on May 18, 2026 for those that proceeded separately.
  6. Paid liabilities and VAT units. Liabilities assessed and paid before a Replacement eLA are treated as settled for that period and tax type and are not re-assessed. VATAS and LTVAU may process pending cases up to May 15, 2026, then stop audit functions except VAT refunds and wind up until May 29, 2026, with case dockets turned over by acknowledged transmittal.
