Summary
RMC No. 04-2018 gives transition procedures for eFPS filers of returns affected by the revised Excise Tax rates under the TRAIN Law. It also introduces two new Excise Tax forms.
Key points
- Forms being enhanced. BIR Form Nos. 2200-T (tobacco), 2200-P (petroleum), 2200-AN (automobiles and non-essential products) and 2200-M (mineral products) are being enhanced.
- New forms. BIR Form No. 2200-S covers the Excise Tax Return for Sweetened Beverages. BIR Form No. 1620-XC covers Final Withholding of Excise Tax on Cosmetic Procedures.
- Interim eFPS filing. Until eFPS is enhanced, eFPS filers e-File with the existing online forms to proceed to e-Payment. The Circular sets separate procedures for returns with Purely Prepayment, Advance Deposit or similar schemes and for returns on Actual Removals.
- New forms filed manually. Forms 2200-S and 1620-XC are filled in using the new tax rates. They are filed and paid manually at Authorized Agent Banks under the taxpayer’s Revenue District Office.
- Announcements and penalties. A BIR website announcement will say whether previously filed Excise Tax returns must be amended. Taxpayers must declare the correct Excise Tax for each removal, and deficiencies found in validation carry the applicable penalties.
Who is affected
- eFPS filers of Excise Tax returns
- Taxpayers of excisable articles
