Key points

  1. Monthly percentage tax and VAT returns. BIR Form No. 2551M is filed and the tax paid not later than the 20th day after each month ends. Returns under Sections 120, 125, 126 and 127 of the Tax Code follow the periods stated in those sections. BIR Form No. 2550M is accomplished only for the first two (2) months of each taxable quarter, with the same 20th day deadline.
  2. Withheld percentage tax and VAT. Withholding agents file BIR Form No. 1600 and pay within ten (10) days after the end of the month of withholding. Percentage tax on winnings and prizes withheld by the payor is remitted using BIR Form No. 1600-WP.
  3. VAT withheld on non-residents. The filed BIR Form No. 1600 and proof of payment support the claim of input tax against output tax of a VAT-registered withholding agent. A non-VAT-registered withholding agent treats the passed-on VAT withheld as part of the cost of the service or as expense, whichever applies.
  4. Fringe benefits tax. The Section 33 tax is a final income tax on the employee, withheld and paid by the employer on or before the 10th day of the month after the calendar quarter in which the benefits were granted.
  5. EFPS enrollees. The e-filing and e-payment deadline for these returns is five (5) days later than the deadlines above.
  6. Certificates and attachments. Withholding agents furnish BIR Form No. 2307 not later than the 10th day of the following month. For percentage tax on winnings and prizes, BIR Form No. 2306 is issued upon request of the payee. The payee attaches a copy of BIR Form 2307 to each return specified in the Regulations.
