Key points

  1. Who continues in office. Officers-in-Charge of departments, agencies, bureaus and offices, non-Career Executive Service officials occupying CES positions, and covered contractual or casual employees continue their duties until 31 December 2022 or until a replacement is appointed or designated, whichever comes first.
  2. Performance duty. Covered officials and employees must perform their duties lawfully and submit bi-monthly performance reports to their respective heads, or be held accountable.
  3. GOCCs not covered. MC Nos. 1 and 3 do not apply, insofar as they declared positions vacant and set rules for vacancies, to GOCCs, government instrumentalities with corporate powers, government corporate entities and government financial institutions. These stay governed by their charters, articles of incorporation and by-laws in relation to RA No. 10149.
  4. No new contracts or extraordinary funds. Covered OICs, the GOCC-type entities until new directors and chief executive officers are in place, and the free port and special economic zone authorities until the same occurs, may not enter into new contracts or projects or disburse extraordinary funds. Exceptions are the food, transportation and energy sectors, or meritorious cases authorized by the President.
