Key points

  1. Reports the BIR provides. The BIR gives the DOE and BOC monthly reconciliation reports on denatured imported bioethanol per oil company, inventory of crude oil, finished petroleum products and biofuel per oil company, and issued withdrawal certificates. It also reports the list of BIR-registered or accredited downstream oil industry participants, such as refiners, importers and terminal operators, plus other information the DOE and BOC may require.
  2. Deadlines. The bioethanol and inventory reports are due on or before the end of the succeeding month from receipt of the DOE report. The other monthly reports are due on or before the end of the succeeding month.
  3. Responsible offices and committee. For the BIR, the Excise Large Taxpayer Field Operations Division (ELTFOD) receives, distributes, collates and reconciles documents from the DOE and BOC. Each Party designates personnel to a reconciliation committee that exchanges information by official e-mail and meets monthly, preferably every Friday of the last week of the month, with special meetings when any Party calls.
  4. Confidentiality. Documents and information stay confidential and are not disclosed to a third party without the prior written consent of the originating Party’s Head of Agency or authorized representative. Use is limited to the MOA’s purpose and to authorized personnel, with penalties under Section 1431 of the CMTA, Section 24 of RA No. 8479, Section 270 of the NIRC and the Data Privacy Act, if applicable.
