Key points

  1. Who may avail. Natural or juridical persons with delinquent internal revenue tax liabilities for taxable year 2017 and prior years, as of April 24, 2019, may avail within one year from the effectivity of RR No. 4-2019.
  2. Qualifying cases. Covered are delinquent accounts, with or without a compromise settlement application, that were denied by or are pending with the Regional Evaluation Board or National Evaluation Board. Also covered are cases with pending criminal cases for tax evasion and other offenses under Chapter II of Title IX and Section 275 of the Tax Code, with or without assessments, cases with final and executory court judgment, and withholding tax liabilities from failure to remit withheld taxes (Section 3, RR No. 4-2019).
  3. Penalties-only assessments. If the assessment notices cover penalties only, without basic taxes, the taxpayer may avail if the penalties pertain to 2017 and prior years and the notices became final and executory on or before April 24, 2019. The amnesty amount is based on the basic tax assessed, so no amount is due.
  4. Denied compromise settlements. Liabilities that became final and executory on or before April 24, 2019 and were covered by a compromise settlement application later denied by the NEB or REB during the one-year availment period can be subject of the amnesty. The tax amnesty return and complete documents must be filed within the one-year availment period.
  5. Questions and answers. The Circular clarifies a total of nine (9) issues, including specific scenarios, in question and answer form.
