Key points

  1. Approval by the NEB. Compromise settlements within National Office jurisdiction are approved by a majority of all NEB members, namely the Commissioner and the four (4) Deputy Commissioners. This does not apply to offers whose approval is delegated to the REB. NEB decisions favorable to the taxpayer need the Commissioner’s concurrence.
  2. Payment on filing. The taxpayer pays the compromise offer when filing the application. No application is processed without full settlement of the offered amount.
  3. If disapproved. If the application is disapproved, the amount paid on filing is deducted from the total outstanding tax liabilities.
