RMC No. 51-2008 circularizes Civil Service Commission Memorandum Circular No. 03, s. 2001, “Revised Policies on Merit Promotion Plan”, on selecting and promoting government employees.

Key points
- Merit-based selection. Selection for government appointment is open to all qualified men and women on merit and fitness. The plan covers first, second and third level positions and original appointments, with no discrimination based on gender, civil status, disability, religion, ethnicity or political affiliation.
- Publication of vacancies. Vacancies are published under RA No. 7041 and posted in at least three conspicuous places for at least ten calendar days. Filling may happen after ten calendar days in NGAs, GOCCs and state universities and colleges, and after 15 calendar days in LGUs. Publication is valid until filled but not beyond six months.
- Exempt positions. Exempt from publication are primarily confidential, policy determining, highly technical and other non-career positions, third level positions (Career Executive Service), and positions filled by existing regular employees in a reorganization.
- Personnel Selection Board. Every agency sets up a PSB for first and second level positions with a prescribed composition, including two rank-and-file representatives who serve for two years. Candidates for third level positions are screened by a PSB of at least three career executive service officials. Some appointments need no PSB screening, such as substitute appointments, entry laborer positions and renewals of temporary appointments.
- Choosing and comparing candidates. The appointing authority selects, as far as practicable, from the top five ranking applicants. Candidates are compared on performance, education and training, experience and outstanding accomplishments, psycho-social attributes and personality traits, and potential. Promotion or transfer requires at least a very satisfactory last rating.
- Promotion limits and notice. An employee may be promoted to a position not more than three salary, pay or job grades higher, except in very meritorious cases. Promotion within six months before compulsory retirement is not allowed except as provided by law. A notice of appointment is posted in three conspicuous places for at least fifteen calendar days.
