Key points
- The inconsistency. The last paragraph of RMO No. 20-2007 is stricter on paying a compromise than the last paragraph of Section 6 of RR No. 30-2002, as amended by RR No. 8-2004. The regulation lets the taxpayer pay the compromise offer before or after the NEB or REB approves it, at the taxpayer’s option.
- Disapproved offers. If a compromise offer that was already paid is disapproved, it is handled under the prevailing procedures in the Revenue Memorandum Order issued for this purpose, including amendments.
- Which rule prevails. A Revenue Regulations ranks higher than a Revenue Memorandum Order. RR No. 30-2002, as amended by RR No. 8-2004, prevails over RMO No. 20-2007 in case of conflict. Provisions of RMO No. 20-2007 not in line with the regulation are deemed modified.
Who is affected
