Key points

  1. Sales to international carriers. For tax-paid petroleum products sold and delivered to international carriers under Section 135(a) and (b) of the Tax Code of 1997, sales invoices and/or official receipts issued in the name of the international carrier and/or the intermediary party/broker are considered sufficient for RMC No. 59-2005 and RMO No. 19-2006.
  2. Other documents still required. The oil manufacturer/producer or importer must also submit the other documentary requirements in those issuances, or other pertinent documents, showing the products were actually sold and delivered to exempt international carriers.
  3. Reconsideration of denied claims. Oil companies whose claims were denied or disallowed for failing the invoicing/official receipting requirement under RMC No. 59-2005 and RMO No. 19-2006 may apply for reconsideration because of this Order.

Who is affected

  • Oil manufacturers/producers and importers with pending refund claims
  • Oil companies whose claims were previously denied or disallowed

Deadlines and effectivity

  • Reconsideration application: not later than 60 days from effectivity of the Order
  • Issued December 27, 2006
